Sweepstakes Rules
NO PURCHASE NECESSARY. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
1. SWEEPSTAKES: The NITRIC OXIDE KNOWLEDGE CENTER Sweepstakes (the “Sweepstakes”) begins October 25, 2008 at 12:01 am EST and ends November 30, 2008 at 11:59 pm EST (the "Sweepstakes Period").
2. ELIGIBILITY: The Sweepstakes is open to individuals who are eighteen (18) years of age or older at time of entry. The following persons are not eligible for the contest: The employees of Sponsor, of The Excelerant Group, of Palio Communications, and each of their respective affiliates, subsidiaries and parents and advertising, promotion and internet agencies; and the immediate family and household members of all such employees. Eligibility and participation is expressly conditioned on the acceptance of these Sweepstakes Official Rules (the “Official Rules”).
3. HOW TO ENTER: There is no purchase necessary to participate. To enter, simply register for the Sweepstakes at www.nitricoxideonline.net by providing the required information. One (1) entry per person. Subsequent or additional entries will be disqualified. All entries will be considered made by the authorized account holder of the email address. In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed to be submitted by the "authorized account holder" person in whose name the e-mail account is registered, provided that person meets the eligibility criteria set forth in this section of these Official Rules.
4. PRIZES: Five (5) winners will each win one (1) iPod Nano (each a “Prize”).]
All other expenses associated with acceptance and/or use of the Prize which are not expressly specified as included in the prize above are solely the responsibility of Prize winner. Without limiting the foregoing, all applicable taxes on the award and use of the Prize are the sole responsibility of the Prize winner. No substitution or transfer of the Prize is permitted except at the discretion of the Sponsor. Sponsor reserves the right to substitute the Prize with another prize of equal or greater value.
5. DRAWING: Potential winners will be selected in a random drawing on or about December 15, 2008– from all eligible entries received. Odds of winning depend upon total number of eligible entries received.
Each potential Prize winner and alternates will be notified by mail and/or e-mail. Prize must be claimed within fourteen (14) days of the notification. Unclaimed Prize will not be awarded.
A potential Prize winner, at his or her sole discretion, may disclaim the Prize by not claiming the Prize within fourteen (14) days of the notification, and an alternate potential Prize winner may be selected from the remaining pool of eligible entries. In addition, any potential Prize winner notification that is not successful based on the information provided on the official sweepstakes entry form will result in Prize forfeiture and an alternate potential Prize winner may be selected from the remaining pool of eligible entries.
6. GENERAL: Sweepstakes is subject to the laws of the United States only. Except where prohibited by law, each entrant agrees that any and all disputes, claims and causes of action arising out of or in connection with the Sweepstakes shall be resolved individually, without resort to any class action, exclusively by the courts located in New Jersey. All information submitted as part of the Sweepstakes will be treated in accordance with the privacy policy at www.nitricoxideonline.net, and each participant agrees that Sponsor may use (subject to the opt-out provisions of Sponsor’s privacy policy at www.nitricoxideonline.net) the entry information to contact him or her regarding promotional offers from Sponsor and its promotional partners.
7. CONDUCT: By entering the Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the judges and Sponsor. Failure to comply with these Official Rules may result in disqualification, and forfeiture of the Prize. Sponsor reserves the right to disqualify any individual suspected of tampering with the entry process or the operation of the website located at www.nitricoxideonline.net or the other websites of Sponsor (the “Web Sites”).
In the event of infection of computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failure or other failures that in Sponsor's sole opinion corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, or if the Sweepstakes is not otherwise capable of running as planned, Sponsor reserves the right to cancel, modify or suspend the Sweepstakes in whole or in part. Any person who supplies false information or obtains prizes by fraudulent means or is otherwise determined to be in violation of these Official Rules in an attempt to obtain any prize or any other unlawful conduct associated with the Sweepstakes will be prosecuted to the fullest extent of the law and may be reported to law enforcement authorities for appropriate action.
8. LIMITATIONS OF LIABILITY; RELEASES: By participating in the Sweepstakes, by accepting or using the Prize, and/or by attending any Prize related activity, each participant agrees that that Sponsor and its designees may use his or her name, city/state of residence, voice and/or likeness and image for advertising, publicity and other purposes worldwide, without permission or additional compensation except where prohibited by law.
The Sponsor, of The Excelerant Group, of Palio Communications, and their respective parents, affiliates, subsidiaries, promotional partners, suppliers, printers, judging agencies, dealerships, franchisees, advertising and promotion agencies and all others entities associated with the development and execution of this sweepstakes, and each of their respective directors, officers, employees and agents (collectively, the “Released Parties”), assume no responsibility or liability for: (a) incorrect, incomplete, garbled, delayed or lost entries (such entries shall be void) or entry information; (b) any unauthorized access to or destruction of entries; (c) any operational or technical malfunctions or errors (including any technical or human error which may occur in the processing of entries which may limit an entrant’s ability to participate in the Sweepstakes); (d) inaccessibility of the Internet or the Web Sites; or (e) any damage to participant’s computer or computer network related to participation in the Sweepstakes. The Prize winner shall bear all risk of loss or damage to their prize after it has been delivered.
To the fullest extent permitted by applicable law, all entrants agree to release the Sponsors and the other Released Parties from any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property (including loss of life) which may be sustained in connection with participation in the Sweepstakes, the acceptance or use of the Prize, and/or any Prize related activity. To the fullest extent permitted by applicable law, each entrant also agrees to indemnify, defend and hold harmless the Sponsor and the other Released Parties from and against any and all claims, demands, proceedings and all damages, costs and expenses (including, without limitation, reasonable attorneys’ fees) arising from or relating to any acts or omissions by such entrant in connection with the Sweepstakes.
Unless prohibited by applicable law, all entrants agree that in any cause of action, the liability of Sponsor and the other Released Parties (if any) will be limited to the cost of entering and participating in the Sweepstakes and Prize related activities, and in no event shall the Sponsor or the other Released Parties be liable for attorneys’ fees, punitive, consequential, direct or indirect damages and each entrant waives the right to claim any damages whatsoever.
9. WINNERS LIST: For a list of winners, please mail a self-addressed stamped envelope postmarked December 31, 2008 to: NicOx Inc. 15, Independence Boulevard, Warren, NJ 07059, United States and reference “NITRIC OXIDE KNOWLEDGE CENTER Sweepstakes Winners List.”
